Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Organization") and mewicu ("Service Provider", "we") regarding the use of the Mfuscator platform, SDK, and associated services (collectively, the "Service").

1. Acceptance

By creating an account, accessing the dashboard, or integrating the SDK, you confirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the authority to enter into this agreement. If you are using the Service on behalf of a legal entity (e.g., a game studio), you represent that you are authorized to bind that entity to these Terms.

2. Service Description ("AS IS")

The Service provides cloud-based processing of files intended to deter reverse engineering.

THE SERVICE IS PROVIDED STRICTLY "AS IS" AND "AS AVAILABLE". To the fullest extent permitted by applicable law, the Service Provider expressly disclaims all warranties, express or implied, including but not limited to:

1. Uptime: We do not guarantee uninterrupted access or specific availability levels.
2. Protection: We do not guarantee that the processed code is secure against all forms of reverse engineering or tampering.
3. Stability: We are not liable for runtime crashes, performance degradation, or compatibility issues resulting from the obfuscation process.
4. Fitness: We make no warranty that the Service will meet your specific requirements or that it is fit for any particular purpose.

3. Account & Security

3.1. Responsibility

You are responsible for maintaining the security of your authentication credentials (Google OAuth) and API Keys. You agree to notify us immediately of any unauthorized access to your account.

3.2. Prohibited Uses (AUP)

You agree not to use the Service to:

• Protect malware, spyware, ransomware, keyloggers, or any software intended to damage or unauthorizedly access computer systems.
• Protect software that infringes on third-party intellectual property or violates applicable laws.
• Attempt to disrupt, reverse engineer, or exploit the Service infrastructure.
• Create multiple accounts to bypass free tier limitations (if applicable).
• Use the Service in connection with any activity that violates Export Control laws.

We reserve the right to suspend or terminate any account found violating these rules without prior notice. In the event of termination for AUP violations (e.g., malware protection), all remaining Credits are forfeited and no refunds will be issued.

4. Virtual Credits & Payments

4.1. Nature of Credits

The Service operates on a pre-paid "Credit" system. Credits are a license to access computational resources.

• No Cash Value: Credits are not a currency, bank balance, or stored value instrument.
• Non-Transferable: Credits cannot be transferred between Organizations or users.
• Merchant of Record: Our order process is conducted by our online reseller freemius.com. freemius.com is the Merchant of Record for all our orders. Refund inquiries are handled by Mfuscator.

4.2. Refunds and Cancellations

All purchases are governed by our Refund Policy. You acknowledge that you have a 14-day right of withdrawal. If you request the performance of services (consume Credits) during this withdrawal period, you may be liable for the proportional value of the services provided.

4.3. Pricing

We reserve the right to modify pricing or Credit consumption rates at any time. Changes will apply to future usage and will not affect previously purchased Credit balances.

4.4. Organization Classifications (Indie vs Studio)

The Service may offer different pricing, quotas, benefits, and support/queue priority based on an Organization's classification.

• Indie: Organizations with aggregate revenue and funding in the last twelve (12) months (rolling) under $200,000 USD.
• Studio: Organizations with aggregate revenue and funding in the last twelve (12) months (rolling) reaching or exceeding $200,000 USD.

By selecting or maintaining a classification, you represent that it is accurate. If your classification changes (for example, because your aggregate revenue and funding reaches or exceeds the threshold), you agree to promptly update it or notify us. We may request reasonable documentation to verify eligibility.

4.5. Referral Program

Where the Service offers a referral program, the following terms apply in addition to the rest of this section.

• Paid in Credits Only: Referral rewards are issued solely as Credits. They are never redeemable for cash and carry every restriction described in §4.1, including having no cash value and being non-transferable.
• Attribution is Established Once: The link between a referring Organization and a referred Organization is created at the moment the referred Organization is approved, using the referral code supplied with its creation request. It cannot afterwards be changed, transferred, or applied retroactively to an existing Organization.
• Single Level: Rewards are earned only on payments made by Organizations you referred directly. No reward is earned on referrals made by those Organizations.
• What Earns a Reward: Only payments of real money for Credits qualify. Promotional Credits, evaluation Credits, free top-ups, voucher redemptions, legacy invoice redemptions, and referral rewards themselves do not.
• Terms are Fixed at Attribution: The reward rate, cap, and duration in effect when a referral is established govern that referral for its lifetime. As with §4.3, changes apply only to referrals established afterwards.
• Holding Period and Reversal: Rewards are held for a period before becoming available to spend. A reward may be withheld, voided, or recovered if the payment that generated it is refunded, reversed, charged back, or otherwise reversed, in proportion to the amount reversed. Where a reward has already been spent, we may recover the shortfall from rewards you earn subsequently.
• Prohibited Conduct: You may not refer yourself, use a referral code belonging to an Organization you control or belong to, coordinate Organizations under common control to generate rewards, or otherwise arrange to earn a reward on your own spending. Doing so voids the referral and any rewards arising from it.
• Verification: We may hold rewards pending manual review where circumstances suggest that the referring and referred Organizations are not independent.
• Changes and Termination: We may suspend, modify, or discontinue the program at any time. Credits already released to you remain yours, and rewards pending on completed, unreversed payments will still be honored.

5. Intellectual Property

5.1. User Assets

You retain full ownership of the input files that are uploaded and the output files generated by the Service. You grant us a limited, worldwide, royalty-free license to host, copy, and process these files solely for the purpose of providing the Service.

5.2. Service IP

The Mfuscator platform, website, dashboard, SDK source code, and obfuscation logic are the exclusive property of the Service Provider.

6. Indemnification

You agree to indemnify, defend, and hold harmless mewicu, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.

7. Export Controls

You acknowledge that the Service and the software provided via the Service may be subject to export control laws and regulations of the United States, the European Union, and other jurisdictions. You warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to comprehensive sanctions (including, without limitation, Cuba, Iran, North Korea, Syria, and the occupied regions of Ukraine) or on any list of prohibited or restricted parties. You agree not to export, re-export, or transfer the Service or software in violation of such laws.

8. Limitation of Liability

To the maximum extent permitted by law:

1. Cap on Liability: Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total amount paid by you to us in the three (3) months preceding the event giving rise to the claim.
2. Exclusion of Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data (including build artifacts), or business reputation.

9. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
